Terms and Conditions

The Advertiser shall agree to all terms and conditions set forth in this Advertiser Agreement (hereinafter “Agreement”). The Company may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes with prior notification of its registered Advertisers (hereinafter “Advertisers”). Instad Web Services Pvt. Ltd. (OPC) is the parent company of Adviuz.in; any reference to Adviuz.in is by incorporation a reference to Instad Web Services Pvt. Ltd. (OPC).

Adviuz Sales Solution is an Innovative solution which helps Advertiser to adopt most powerful and result oriented sales solution comprises of paperless pamphlets advertising, advanced lead management system, super strong follow-up system & outsourced professional deal closers in one package and that too with 5 Guaranteed Bookings in 90 days or Money back guarantee for non-bookings ( terms and conditions apply)

1. Eligibility:

Any RERA registered builder or Construction Company can adopt this service with the condition that the product or service they are selling should be defect free, reliable and legal.

Once Booking Payment is collected, Booking is consider as done and our responsibility is over.
Once booking is considered as done, it will be deducted from your top-up.

Important Note:

Account Setup + Design require 7 working days or more depending on availability of content. Target duration will only start after campaign get live.

4. Advertiser Responsibilities

Site Demonstration
Providing us accurate information about the project
Providing us design material as mentioned at step 2 in design section at www.adviuz.in/demo
Coordination with our sales Team failure to which may result in loosing bookings.
Documentation of Customer
Loan & finance.
Advertising
All property related issue will be handled by builder
Loan Processing and property documentation is responsibility of Builder and customer.

5. Payment

This is a prepaid system in which advertiser top-up for number of bookings at fix cost of one lakh fifty thousand + Taxes, full Payment should be done before starting the process.

6. Booking Cancellation

In case, booking got cancelled at Buyer’s end due loan issue then booking cancellation will be considered and advertiser account will be credited with one booking. Please note that in case of booking cancellation only booking credit will be provided and no refund amount would be paid as booking got generated using our services and if it got cancelled due to loan that’s not in our hand to process & approve loans, what we can do best is replace that booking with another one.

7. Refund

If we are not able to complete the target in desired time then you have the option demand refund or credit for pending bookings. Example: Our Target is 5 bookings in 90 days and we only able to give you 4 bookings in 90 days then you can ask for refund of 1 Booking that is 1.5 Lac + GST or if you want to go ahead with our service to generate another 5 bookings, then you need to top up only for 4 bookings. In case of no bookings generated in 90 days advertiser can either extent the time if there are near bookings in pipeline or apply for refund which will be processed in 30 days from the date of request. Refund payment will be done only done by cheque.

8. Non Refund

Advertiser is not liable for refund or booking credit incase booking got cancelled due to following reasons

Advertiser has done any sort of false commitments, giving wrong information either in written or verbal with Adviuz.in or buyer. Example: False advertisements, mentioning different carpet areas during selling and giving different carpet area in agreement, mentioning wrong possession date, mentioning false amenities, mentioned false date of start of facilities.
Advertiser has given us wrong information to advertise.
Advertiser didn’t process the paperwork of client on time.
Advertiser delayed the agreement
Advertiser didn’t cooperated with client in loan process & documentation.
Advertiser not able to perform recommendations of Adviuz.in on time.
Conflicts between advertiser and buyer due to lack of service at advertiser end.
Property found disputed or having any legal issues on it due to which buyers back step.
If buyer back step due to reason that his flat work not getting done as per the agreed quality and on time.

9. Limitation of Liability

Adviuz.in will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Adviuz.in.

The provisions of this section survive termination or expiration of the Agreement. Adviuz.in makes no express or implied warranties or representations with respect to the Advertiser program or any services or other items advertised through Adviuz.in. This including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage).

Adviuz.in makes no representation that the operation of Adviuz.in will be uninterrupted or error-free, and shall not be liable for the consequences of any interruptions or errors. Adviuz.in is not responsible in the event of Advertiser’s network or system becomes infected with malware, virus or other program that affects the performance. It shall be the Advertiser’s responsibility to maintain industry-standard anti-virus and anti-malware program on their system.

10. Indemnification

The Advertiser hereby agrees to indemnify, defend and hold harmless Adviuz.in, its officers, directors, employees, agents, Advertisers, successors and assigns, from and against any and all claims, losses, liabilities, damages or expenses (including attorney’s fees and costs) of any nature whatsoever incurred or suffered by us (collectively the “Losses”).

11. Database

Adviuz.in is an advertisement platform where customer enquire about various services. There may be possibility that same customer will inquire about multiple products of same or different domain either by phone or enquiry form. Advertiser cannot claim any right on any type of inquires

12. Legal

All legal disputes will be in Pune only.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND ADVIUZ.IN AND BY REGISTERING THE ADVERTISER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS ADVERTISER AGREEMENT. BY ACCEPTING THIS ADVERTISER AGREEMENT YOU ARE HEREBY BOUND TO THE RULES AND GUIDELINES LISTED ABOVE. PLEASE READ THIS ENTIRE ADVERTISER AGREEMENT CAREFULLY BEFORE ACCEPTING ITS TERMS.
